Resolution to Approve a Contract with Spence Brothers to Construct the Headworks Improvement Project at the Wastewater Treatment Plant, ITB No. 4706 ($12,261,000.00)

Your approval is requested to approve a contract with Spence Brothers in the amount of $12,261,000.00 to construct the Headworks Improvement Project at the City’s Wastewater Treatment Plant (WWTP).
The WWTP headworks systems provide initial treatment to remove debris (screenings) and grit from the water as the first stage of treatment, which prevents damage to downstream equipment and systems. The existing headworks consists of three mechanical bar screens, three screw compactors and two grit removal systems including pumps, swirl separator and grit washer. The bar screens were installed in 1989 and in 2000 and require frequent repair and rebuilding. The grit system was also installed in 2000 and has required pump replacement and rebuilding of the swirl concentrators and washers over time. In addition, WWTP staff have observed significant accumulation of grit downstream of the removal system that indicates the efficiency of the grit system is significantly diminished and negatively impacts downstream equipment and systems. The cost and frequency for maintenance of the headworks have increased and parts for the screening systems are no longer available and must be custom fabricated. These systems are nearing the end of their useful life and are in need of replacement to ensure effective screenings and grit removal.
The Headworks Improvement Project includes replacement of the bar screens, grit removal equipment, screening and grit processing equipment, and installation of odor control improvements for the headworks buildings. In response to ITB No. 4706, three bids to construct the Headworks Improvement Project were received and publicly opened on January 26, 2022. There were two screening options submitted for each bid. The bid prices were as follows:

WWTP staff reviewed the bids, compared them to ITB No. 4706 specifications and recommends that Spence Brothers be approved as the lowest responsible bidder to construct the Headworks Improvement Project. WWTP staff selected the Hydro-Dyne Screen option, which is the lower cost bid option and has higher removal efficiency.
WWTP staff is requesting your approval of a contract with Spence Brothers in the amount of $12,261,000.00 to construct the Headworks Improvement Project and to approve a contingency in the amount of $1,225,000.00 to fund any additional necessary services as approved by the City Administrator.
Spence Brothers complies with the City’s Non-Discrimination and Living Wage ordinances.
Budget/Fiscal Impact: Total project cost (UT-SN-20-06) is estimated at $15,100,000.00 and is included in the Sewage Disposal System Capital Improvements Plan.

Whereas, On January 26, 2022, three competitive bids were received in response to ITB No. 4706 to construct the Headworks Improvement Project and based on review of these bids WWTP staff recommends Spence Brothers as the lowest responsible bidder for this work in the amount of $12,261,000.00;
Whereas, The project, UT-SN-20-06, is included in the Sewage Disposal System Capital improvements Plan; and
Whereas, Spence Brothers, Inc. complies with the requirements of the City’s Non-Discrimination and Living Wage ordinances;
Resolved, That City Council approve a construction contract with Spence Brothers in the amount not to exceed $12,261,000.00 for the WWTP Headworks Improvement Project (ITB 4706);
RESOLVED, That a contingency amount of $1,250,000.00 be established within the project budget and that the City Administrator be authorized to approve change orders to the construction contract not to exceed that amount, in order to satisfactorily complete this project;
RESOLVED, That the Mayor and City Clerk be authorized to sign said contract after approval as to substance by the City Administrator and approval as to form by the
City Attorney;
RESOLVED, That the City make the following declaration for the purpose of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended: that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds; and
RESOLVED, That the City Administrator be authorized to take the necessary actions to implement this resolution.
