Attached for your review and approval, please find a resolution to approve an agreement between the City of Ann Arbor and the Michigan Department of Transportation (MDOT) for the installation and upgrading of bike lanes at various locations in the city.  The agreement is required so that this project can be performed as a federal aid project using American Recovery and Reinvestment Act (ARRA) funding.
 
The project consists of installing 9.8 miles of new or upgraded on-street bike facilities for 34 streets within the City.  This would include installing new bike lanes on First, Ashley, Ann, N. University, E. University, S. University, Pauline, Catherine, Hill, Seventh, Green and Hoover.  Upgrades will take place primarily in the downtown area placing new non-motorized traffic signs, marking select locations with shared use arrows and placing bike yield to pedestrian signage.
 
The construction plans were prepared by staff and submitted to MDOT for their March 5, 2010 bid letting.  The project construction cost is estimated at $265,000.00 with $250,000.00 in ARRA Federal grant (capped) and $15,000.00 in local participation.  Any reduction in the actual bid will reduce the City's commitment. Construction is scheduled to begin in August 2010 and continue until September 2010.  Like all such projects, MDOT will award the construction contract and the City of Ann Arbor will act as the Project Manager.   
 
One requirement for this type of project is that the City enters into an agreement with the State stipulating the funding split and other rights and responsibilities of the parties. It is the same type of agreement that we have used on other federally funded projects.  Federal ARRA Funds will supply 100% of the participating construction cost and construction engineering up to the capped amount of $250,000.00.  The remaining cost of the construction contract/ construction engineering, testing, and all non-participating items of work will be funded from the City of Ann Arbor Alternative Transportation Capital Projects Budget as shown below:

Whereas, The Federal Highway Administration has allocated funds for the installation of bike lane improvements on various roadways within the City of Ann Arbor;
 
Whereas, Funds for the local share for this project in an amount not to exceed $54,000.00 are available in the City's approved Alternative Transportation capital budget; and
 
Whereas, The construction and installation of improvements will enhance non-motorized mobility and safety;
 
RESOLVED, That the City Council authorizes an Agreement with the Michigan Department of Transportation for the Citywide Pedestrian Safety Improvement Project in an amount of $250,000.00;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to form by the City Attorney, and approval as to substance by the City Administrator; and
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
