Resolution to Increase Purchasing Authority on the Construction Contract with E.T. MacKenzie Company for the Stadium/Washtenaw Area Utility Improvements Project ($5,343.54 Increase; $2,018,243.54 Total)
Memorandum
Attached for your approval is a resolution authorizing an increase in purchasing authority on the construction contract with E.T. MacKenzie Company (MacKenzie) for the Stadium/Washtenaw Area Utility Improvements Projects. This contract was used to perform water main replacement, drainage structure replacement, sidewalk installation, and street resurfacing on the areas impacted.
Council approved a construction contract with MacKenzie on 4/18/2022 for the project (R-22-109). The work was performed and completed in November 2022. As part of the that Resolution, Council approved a contingency amount of $183,000.00. However, due to a calculation error on the part of staff, that contingency amount was exceeded by $5,343.54. Therefore, this Resolution is being submitted to request additional purchasing authority on this contract, which will allow staff to make the final payment to the contractor and close out the project.
Mackenzie complies with the City’s Non-Discrimination and Living Wage ordinances.
Budget/Fiscal Impact: Funding for this change order is available within the project budget.

Whereas, Council awarded a construction contract for the Stadium/Washtenaw Area Utility Improvements Project to E.T. MacKenzie Company on 4/18/2022 (R-22-109);
Whereas, E.T. MacKenzie Company has completed the contract work in November 2022.
Whereas, Due to a miscalculation, the approved contingency on the contract was exceeded by $5,343.54;
Whereas, It is now necessary to request additional purchasing authority on the construction contract with E.T. MacKenzie Company in order to issue final payment and close out the project; and
Whereas, Funding for this change order is available within the project budget;
RESOLVED, That City Council approves an increase in the purchasing authority on the contract with E.T. MacKenzie Company in the amount of $5,343.54 for the Stadium/Washtenaw Area Utility Improvements Project; and
RESOLVED, That the City Administrator be authorized to take the necessary actions to implement this resolution.
