Resolution to Approve a Professional Services Agreement with Black & Veatch Ltd. of Michigan to Design the Ultraviolet (UV) Disinfection System Replacement Project at the Wastewater Treatment Plant, RFP 22-22 ($307,471.00)

Your approval is requested for a Professional Services Agreement with Black & Veatch Ltd. of Michigan (B&V) in the amount of $307,471.00 for professional engineering services to design the Ultraviolet (UV) Disinfection System Replacement Project for the City’s Wastewater Treatment Plant (WWTP).
The City of Ann Arbor WWTP currently uses a Trojan UV4000 disinfection system to disinfect the WWTP’s final effluent. The current system has been in service since December 2000 and production of certain parts and maintenance items are being phased out by the manufacturer. In addition, the system has reached the end of its useful life and must be replaced.
RFP No. 22-22 was prepared seeking the services of a professional engineering firm to review existing operations, collect additional data and information, propose alternative UV disinfection systems and prepare contract documents for a replacement UV disinfection system based on the selected alternative.
On April 6, 2022, the City received four proposals for this work. The RFP required each consultant to submit a statement of qualifications including past involvement with similar projects, work plan, fee schedule, and resumes of personnel that they proposed were qualified and available to work on the UV Disinfection System Replacement Project. WWTSU staff reviewed the proposals and determined which firms were most quailed to perform the required services. The firms were evaluated and scored on the following criteria:
• Professional Qualifications (25%)
• Past Involvement with Similar Projects (25%)
• Proposed Work Plan (35%)
• Fee Proposal (15%)
After evaluation of the proposals, two firms were selected to be interviewed, and their fee proposals were opened. After the interviews, the two firms were further evaluated, and it was determined that B&V provided the best proposal and best qualified project team at a competitive price.
WWTP staff is requesting your approval of a Professional Services Agreement with B&V in the amount of $307,471.00 and a contingency of $31,000.00 to provide professional engineering services for the design the UV Disinfection System Replacement Project.
B&V complies with the requirements of the City’s Non-Discrimination and Living Wage ordinances.
Budget and Fiscal Impact: The City of Ann Arbor Capital Improvements Plan (CIP) includes the WWTP UV Disinfection Replacement (UT-SN-22-01). Total estimated project costs are $1,950,000.00. Funds to finance this contract are included in the approved Sewage Disposal System Capital Budget.

Whereas, After WWTP staff evaluated proposals, fees and conducted interviews, it was determined that Black & Veatch Ltd. of Michigan (B&V) is the best qualified engineering firm to provide the professional services requested in RFP No. 22-22;
Whereas, B&V’s proposed fee of $307,471.00 is reasonable to perform this work;
Whereas, WWTP staff request that Council approve a contingency of $31,000.00 to fund additional necessary services as approved by the City Administrator;
Whereas, B&V complies with the requirements of the City’s Non-Discrimination and Living Wage ordinances; and
Whereas, Funds are available in the Sewage Disposal System Capital Budget;
RESOLVED, That City Council approve a Professional Services Agreement with Black & Veatch Ltd. of Michigan in the amount of $307,471.00 to provide professional engineering services to design the WWTP UV Disinfection System Replacement Project as requested in RFP No. 22-22;
RESOLVED, That Council approve a contingency of $31,000.00 to fund additional necessary services as approved by the City Administrator;
RESOLVED, That the Mayor and City Clerk be authorized to sign the agreement after approval as to substance by the City Administrator and approval as to form by the City Attorney; and
RESOLVED, That the City makes the following declaration for the purposes of complying with the reimbursement rules of Treasury Regulations 1.15-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expect to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds; and
RESOLVED, That the City Administrator be authorized to take all necessary actions to implement this resolution.
