Mayor John Hieftje called the regular session of the Ann Arbor City Council to order at 7:10 p.m. in the City Hall Council Chamber, 100 N. Fifth Ave, Ann Arbor, Michigan.
Council stood for a moment of silence.
Mayor Hieftje led Council in the recitation of the Pledge of Allegiance.

INTRODUCTIONS
MESSAGE FROM THE MAYOR
The Mayor announced that the Pfizer Corporation would be leaving the Ann Arbor area as part of a global restructuring. The decision made by the Pfizer Corp. had nothing to do with the City of Ann Arbor or with the State of Michigan. This was a decision made at the corporate level of Pfizer.

Laurel Federbush, 2000 Anderson Court, addressed Council regarding divestment from Israel.
HENRY HERSKOVITZ - PALESTINE
Henry Herskovitz, 404 Mark Hannah Place, addressed Council regarding issues in Palestine.
DAVE DeVARTI - HOUSING POLICY BOARD
Dave DeVarti, 1231 Baldwin Ave., addressed Council regarding his opposition to combining the Housing Policy Board with the Community Development Executive Committee. He asked that Council hold a public hearing on the issue.
THOMAS PARTRIDGE - SAVING AND EXPANDING AFFORDABLE HOUSING
Thomas Partridge, 2242 Eyrie Drive, addressed Council regarding saving and expanding affordable housing in Ann Arbor.
PUBLIC HEARINGS
BARTON GREEN ZONING (ORDINANCE NO. 47-06)
A public hearing was conducted on the proposed amendment to Chapter 55, rezoning of 31.93 acres from TWP (Township District) to R4A (Multiple-Family Dwelling District), Barton Green property, located on the west side of Pontiac Trail, north of Skydale Drive. Notice of public hearing was published January 7, 2006.
Dennis Mannisto, adjacent property owner, spoke in support of the proposed Barton Green rezoning.
Karen Johnson, 333 Skydale, spoke in opposition of a full access road into the Huron Highland neighborhood. She was not opposed to the development of the property.
Mary Bruening, 278 Larkspur, expressed concern with the proposed rezoning.
Thomas Partridge, 2242 Eyrie Drive, expressed concern with the proposed zoning.
There being no further comment, the Mayor declared the hearing closed.
BARTON GREEN AREA PLAN
A public hearing was conducted on the proposed resolution to approve the Barton Green Area Plan, 31.93 acres, located on the west side of Pontiac Trail, north of Skydale Drive. Notice of public hearing was published January 14, 2006.
There being no one present for comment, the Mayor declared the hearing closed.
URS CORPORATION AIRPORT LAYOUT PLAN UPDATE
A public hearing was conducted on the proposed resolution to approve the URS Corporation Airport Layout Plan Update for the Ann Arbor Municipal Airport. Notice of public hearing was published January 21, 2006.
There being no one present for comment, the Mayor declared the hearing closed.

COUNCILMEMBER KUNSELMAN
Councilmember Kunselman announced that the Park Advisory Commission tabled a proposal he was planning to present to Council at this meeting.
COMMUNICATIONS FROM COUNCIL
COUNCILMEMBER LOWENSTEIN
Councilmember Lowenstein asked for a brief overview regarding tree branches that have fallen throughout the City as a result of an ice storm last week.
Sue McCormick, Public Services Area Administrator, said that a press release was given last week explaining how those branches would be removed. Information regarding the scheduled removals will be available on the city’s web as well as broadcast on CTN.
COUNCILMEMBER KUNSELMAN
Councilmember Kunselman informed Council of the passing of former Councilmember Norris Thomas, who served in the 1970s. He asked if there was a procedure for remembering his work as a councilmember.
Councilmember Woods said that a proclamation could be made in honor of him through the Mayor’s Office.

Resolution to Authorize Purchase Order to Phoenix Services, LLC for Temporary Staffing Services
Whereas, Staff is in the process of assessing four vacant positions to determine whether to fill these positions with permanent staff;
Whereas, Staff concluded that it is best to wait until the move to the new Field Operations and Maintenance Building to further assess the need to fill the vacant positions;
Whereas, By utilizing temporary outside services staffing the City will realize a short-term savings this fiscal year as compared to budgeted expenses; and
Whereas, Phoenix Services, LLC., was granted Living Wage approval on July 31, 2006, and received Contract Compliance on December 20, 2006.
RESOLVED, That City Council approve the purchase order to Phoenix Services, LLC., for temporary staffing, in the amount of $85,000.00;
RESOLVED, That the City Administrator is authorized to issue a purchase order in the amount of $85,000.00 to Phoenix Services, LLC.; and
RESOLVED, That the temporary staffing be funded from the Sewage Disposal Fund, Major Street Fund and Parks Repair and Restoration Fund of the approved FY 06/07 Field Operations operating budget.

Resolution to Authorize a Purchase Order to Michigan Waterworks, Inc. to Purchase Services and Materials for Emergency Repairs to Water Mains
Whereas, There have been failures of several water mains bringing to our attention valves that are no longer operational;
Whereas, The work will allow staff to perform preventative maintenance to assure minimum interruptions to water services and lower the number of emergency repairs.;
Whereas, The line stop materials and valve replacement and repairs will allow staff to schedule water main shut-downs and promptly respond to emergency situations;
Whereas, Michigan Waterworks is the only company that has responded to provide bids, so they are being considered a sole source provider; and
Whereas, Michigan Waterworks Inc., received Living Wage approval and Contract Compliance on December 8, 2006;
RESOLVED, That City Council authorizes the purchase order to Michigan Waterworks, Inc. in the amount of $50,000.00 to purchase material for emergency repairs to water mains; and
RESOLVED, That funds be available in the approved FY 06/07 Water Supply System operating budget; and
RESOLVED, That City Council authorize City Administrator to issue a purchase order Michigan Waterworks in the amount of $50,000.00.

Resolution to Grant Water and Sewer Services
Outside City Limits to 3109 Cherry Tree Lane and
Payment of Improvement Charges in Installments
Whereas, The Jean England Revocable Trust Dated September 25, 2006, Jean M. England, Primary Trustee, has requested that the City extend public water and sewer service to the property in Pittsfield Township;
Whereas, Jean M. England as Primary Trustee desires to enter into an agreement with the City to provide an equitable method of obtaining City services outside of its corporate boundaries;
Whereas, Jean M. England as Primary Trustee requests the agreement include a payment plan for payment of the improvement charges of $11,194.00 and $17,877.00 for water and sanitary sewer, respectively; and
Whereas, Jean M. England as Primary Trustee has paid applicable connection charges for the occupied property;
RESOLVED, That the Mayor and Clerk be authorized and requested to sign the agreements to allow City water and sewer services to the land during the time it is still outside of the Corporate City Limits;
RESOLVED, That the Mayor and Council approve a payment of the water improvement charge of $11,194 and the sanitary sewer improvement charge of $17,877.00 in installments over a 15 year period, to be billed and paid quarterly on the property owner’s utility bill, at a 6.4% interest rate per annum, and to be billed on a lot assessment subsequent to annexation;
RESOLVED, That the City Administrator be authorized to take any other necessary administrative actions to implement this resolution; and
RESOLVED, That the Public Services Area promptly record the agreements in the Office of the Register of Deeds of Washtenaw County, Michigan, and send an approved copy of the resolution and an executed copy of the agreements to the owner.

Resolution to Authorize City Administrator to Execute Outside City Service Agreements and Payment Provisions for Single and Two Family Residential Parcels within the Envisioned Future Boundary of the City of Ann Arbor
Whereas, City Code 2:23 and 2:424 prohibits water and sewer services, respectively, to consumers outside City limits except pursuant to agreements with provisions as approved by City Council;
Whereas, The following agreements are in place:
• “Policy Statement Between City of Ann Arbor and Ann Arbor Charter Township” dated January 17, 1994;
• “First Amendment to Policy Statement Between City of Ann Arbor and Ann Arbor Charter Township” dated October 22, 2004;
• “Promulgation of Annexation Policy (City of Ann Arbor - Scio Township)” dated June 29, 1979; and
• “City of Ann Arbor-Charter Township of Pittsfield Policy Statement” dated January 15, 1979;
Whereas, Residential township properties, not subject to site-planned development, connecting to City sanitary sewer have a diminutive impact on the sanitary sewer system and the property owners are not required to provide mitigation;
Whereas, The City’s water and sanitary sewer systems has the available capacity and are the only systems that can practically and reasonably furnish this service to the properties listed in “Attachment A”;
Whereas, The process and time required for each Outside City Service Agreement to be presented to and approved by City Council is time consuming and inconsistent with the customer service objective of providing water and sanitary sewer service promptly when needed; and
Whereas, City Code 2:23 and 2:424 for water and sewer services, respectively, allow City Council to permit the payment of improvement charges in installments “over a 6-year period, or other period, with interest not to exceed 9% per annum;”
RESOLVED, That City Council authorize water and/or sanitary sewer Outside City Service Agreements with residential Township parcels with one or two family homes within the envisioned future boundary of the City of Ann Arbor as listed in “Attachment A” to allow City water and sewer services to the property during the time it is still outside of the Corporate City Limits, provided that the property otherwise complies with all applicable City Code requirements to receive such service;
RESOLVED, That the Outside City Service Agreements shall include the requirement that the property must annex into the City of Ann Arbor and other requirements, that the owner of the subject property is to pay double the normal city utility rates for the service that the City is providing, and, unless otherwise provided by the aforementioned policy statements, pay to the City annually a sum equal to the City tax rate applied to the taxable valuation of the property being serviced, until the property is annexed into the City, as well as all other terms and provisions required by City Code;
RESOLVED, That City Council approve payment of improvement charges in installments over the periods of time shown in “Attachment B”;
RESOLVED, That City Council approve improvement charge to be billed and paid quarterly on the property owner’s water or sewer utility bill prior to annexation, and to be billed on a lot assessment subsequent to annexation;
RESOLVED, That City Council approve the interest rate charged on installment payments be 1% above the interest rate of any bonds issued to finance the improvements, or, when non-bonded funds are utilized to finance the construction of a water or sanitary sewer main the interest rate be 1% over the City’s cost of funding the construction project as established each year or each project by Financial Services, but not to exceed 9% per annum;
RESOLVED, That City Council authorize and direct the City Administrator to execute the Outside City Service Agreements with residential properties with one and two family homes that are within the envisioned future boundary and listed on Attachment A, and that otherwise comply with all applicable City Code requirements to receive such service, provided that the time period and interest rate for any included installment payments
comply with the time periods and rates approved by this Resolution, after approval as to substance by the Public Services Administrator and approval as to form by the City Attorney;
RESOLVED, That City Council authorize the City Administrator to take necessary administrative actions to implement this resolution; and
RESOLVED, That Public Services Area promptly record each agreement in the office of the Register of Deeds of Washtenaw County, Michigan and send an executed copy of the agreement to the owner.

Whereas, Franklin Covey received Human Rights approval July 3, 2006 and is in compliance with the Living Wage Ordinance;

Whereas, William (Bill) R. Wheeler has dedicated his career to the City of Ann Arbor starting as Water Treatment Plant Engineer in July of 1969 and then serving in several other capacities including City Engineer, Public Services Director and Major Projects Manager;
Whereas, William R. Wheeler has continuously and faithfully served the residents and businesses of the City of Ann Arbor for nearly 38 years with a high degree of integrity, proficiency, professionalism, and focus on customer service, which demonstrate outstanding personal and individual commitment to serving the Ann Arbor public;
Whereas, During his career, Bill has performed or directed significant and noteworthy efforts including, but not limited to, Water Treatment Plant improvements, development of construction standards to assure consistent quality in private development construction of City infrastructure systems, securing millions of dollars in State & Federal transportation grants, reconstruction of the Broadway and Huron River Bridges, steady improvement of the quality of Ann Arbor local streets final and proper closure of the City's landfills including achieving compliance with State requirements, the current construction of the Field Operations and Maintenance Facility and hundreds of other Capital improvements to City infrastructure; and
Whereas, The City Council desires to name the complex commonly referred to as the Swift Run Service Center, in the area bounded on the East by Platt Rd, on the West by Stone School Rd, on the North by Ellsworth Road and on the South by East Morgan Rd. in recognition and appreciation of the career of William R. Wheeler for his outstanding service to the Ann Arbor community;
RESOLVED, That the area commonly known as the Swift Run Service Center be henceforth known as the City of Ann Arbor W. R. Wheeler Service Center; and
RESOLVED, That Council direct the City Administrator to install monument signage at significant entrances to the W. R. Wheeler Service Center off Ellsworth and Platt Roads, and that a public dedication ceremony recognizing the new naming be scheduled at an appropriate time.

Resolution to Approve the FY 2007-2008 and FY 2008-2009 Human Service Funding Priorities and Categories
Whereas, The City of Ann Arbor’s Community Development Executive Committee (CDEC) is preparing for the FY 2007-08 and FY 2008-09 Human Services General Fund and CDBG funding cycle;
Whereas, The CDEC has advised that the FY 2007-08 and FY 2008-09 funding categories be the same as FY 2006-07, which are Housing Stability, Youth, Health and Economic Stability;
Whereas, The CDEC would like to advise City Council on the percentage amounts allocated to each category as follows:
2007-09 % of Budget:
Housing Stability 50%
Youth 10%
Health 25%
Economic Stability 15%
Whereas, The Economic Stability category will be reduced by 5% from last’s years percentage based on low funding requests within the category;
Whereas, The Health Category will be reduced by 5% from last year’s funding;
Whereas, The Housing Stability category will be increased by 10% due to the amount of requests within the category and is consistency aligned with the 10-year Plan to End Homelessness; and
RESOLVED, That City Council approve the funding categories and the percentages allocated:
2007-09 % of Budget:
Housing Stability 50%
Youth 10%
Health 25%
Economic Stability 15%
RESOLVED, That the City Administrator be authorized to take necessary administrative actions to implement this resolution.

Resolution to Create the Housing and Human Services Advisory Board, Eliminate the Existing Community Development Executive Committee and Housing Policy Board, and Retain the Existing Waiver and Review Board
Whereas, HUD requires communities that receive CDBG and HOME funds to have a citizen participation process;
Whereas, When the City of Ann Arbor originally received federal funds, neighborhood groups facilitated this citizen participation process through the CDBG Executive Committee;
Whereas, The Housing Policy Board (HPB) was created to monitor the implementation of the City’s housing policy and the creation of a City Housing Coordinator to oversee, carry out and coordinate these policies;
Whereas, The roles of the CDBG Executive Committee and the Housing Policy Board have evolved over the years to a Committee and Board that reviews project details and recommends specific funding allocations; and
Whereas, There has been an expressed desire and need to have higher-level discussions about priorities, policies, and development of a plan to provide a clear vision to address the housing and human service needs of the low-income residents of the community;
RESOLVED, That, effective June 1, 2007, City Council dissolve the current Housing Policy Board and CD Executive Committee and in their place create the Housing and Human Services Advisory Board (HHSAB) to provide policy direction to the City Council and City administration around the housing and human service needs of low income residents of the City as detailed in the attached advisory board charter;
REVOLVED, That City Council retain the Waiver and Review Board as a stand-alone board to review and make recommendations on discreet funding requests that fall outside the City’s Housing Program Guidelines; and
RESOLVED, That City Council direct the new HHSAB to develop a 12-month work plan and by-laws within three months of their initial meeting that once adopted by the Board, be brought forward for City Council approval.
Councilmember Rapundalo moved, seconded by Councilmember Teall, that the resolution be adopted.
Councilmember Suarez moved, seconded by Councilmember Johnson, to postpone the resolution until March 19, 2007.

the dda, Accept and Appropriate Funds, and Establish a Project Budget of $121,000.00 for the Ann Arbor Discovering Downtown Parking Strategy Project - Phases II-IV
Whereas, On March 20, 2006, City Council adopted Resolution R-94-3-06 to approve the Implementation Plan for the Downtown Development Strategies Final Report;
Whereas, On July 17, 2006, City Council adopted Resolution R-332-7-06 to approve the work plans for the high priority projects of the Implementation Plan, including the recommendation to pursue a comprehensive parking strategy for Ann Arbor, focusing on the downtown;
Whereas, The Downtown Development Authority (DDA) issued a Request for Proposals and subsequently selected Nelson\Nygaard Consulting Associates through a competitive process to complete Phase I of the comprehensive downtown parking strategy work plan;
Whereas, The Ann Arbor Discovering Downtown (A2D2) Steering Committee reviewed the work plan for the comprehensive downtown parking strategy in December 2006 and identified revisions for Phases II-IV of the project; and
Whereas, City Council desires to retain Nelson\Nygaard Consulting Associates to complete Phases II-IV, per the scope of work dated January 19,2007; and
Whereas, Upon receiving a request for funding from City Council, the DDA Operations Committee will make a recommendation on January 24, 2007, and the DDA Board will vote on this recommendation on February 7, 2007;
RESOLVED, That City Council approve the attached revised work plan, dated January 22, 2007, for a comprehensive downtown parking strategy;
RESOLVED, That City Council approve a contract between the City and Nelson\Nygaard Consulting Associates to provide consulting services in the amount of $110,000.00 for Phases II-IV of the comprehensive downtown parking strategy work plan;
Resolved, That a total project budget of $121,000.00, including a 10% contingency, be established for the life of the project without regard to fiscal year in order to fund this project;
RESOLVED, That City Council requests that the Downtown Development Authority support this initiative by providing funding of up to 50% toward the cost of consulting work, to a maximum of $60,500.00, to be accepted as a grant to the City’s General Fund, and approve the appropriation of the grant received to the Ann Arbor Discovering Downtown project;
RESOLVED, That City Council approve the allocation of up to $60,500.00 from the FY 06-07 Community Services Area Non-department general fund budget for the comprehensive downtown parking strategy project;
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute a contract between the City and Nelson\Nygaard Consulting Associates after approval as to substance by the City Administrator and approval as to form by the City Attorney, contingent upon the receipt of necessary funding from the DDA, and Human Rights and Living Wage approval; and
RESOLVED, That the City Administrator be authorized to take all necessary administrative actions to implement this Resolution, including the authority to approve change orders within the approved contingency.

Resolution to Approve the URS Corporation Airport Layout Plan Update for the Ann Arbor Municipal Airport,
which Illustrates Existing and Proposed Facilities to
meet the Future Demands of Airport Tenants and Users
Whereas, An approved Airport Layout Plan (ALP) is required by the FAA and the Michigan Department of Transportation (MDOT)-Bureau of Aeronautics for the Ann Arbor Municipal Airport to participate in the federal and state airport improvement program;
Whereas, The airport’s ALP is no longer current and does not depict all airport facilities as required by the FAA and MDOT-Bureau of Aeronautics;
Whereas, The MDOT-Bureau of Aeronautics and FAA, funded the ALP Update at a cost split of 90% Federal, 5% State, and 5% City and URS Corporation a Michigan Planning and Consulting firm was selected to develop the plan;
Whereas, The recommended ALP document depicts existing and future airport facilities and was completed using FAA and MDOT design and planning standards, which included the requirement for participation by users, tenants and the general public; and
Whereas, On July 19, 2006, the Airport Advisory Committee voted unanimously to recommend City Council approval of the ALP Update for the Ann Arbor Municipal Airport;
RESOLVED, That Council approve the ALP Update for the Ann Arbor Municipal Airport;
RESOLVED, That the Mayor and City’s Airport Manager be hereby authorized and directed to execute said ALP Document after approval as to form by the City Attorney and approval as to substance by the City Administrator; and
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
