Resolution to Place Delinquent Water Utilities Charges to the 2008 Tax Roll ($104,402.64)

Memorandum

Your approval is requested to place delinquent Water Utilities charges, which have remained unpaid for six months or more, on the July 2008 tax roll. 

 

These delinquent charges are a lien on the property served as provided by the State of Michigan Public Act 94 of the Public Acts of 1933.  Any such charge delinquent for six months or more is placed on the City's July tax roll with a 10% penalty pursuant to the City Ordinance Code, Chapter 29, Section 2:72 and Chapter 13, Section 2:92. (Excerpts from the Public Act and the ordinance are on attachment #1.)

 

On April 7, 2008 the City Administrator reported to this Council that there were $157,773.05 of unpaid charges for water, sanitary sewer and stormwater services furnished to certain premises in the City, which on March 31, 2008 had remained unpaid for a period of six months or more, including two accounts, which are responsible for $55,509.90 of the outstanding debt.  Additional payments have further reduced this amount.  As of this date, $104,402.64 is presently unpaid.  This $104,402.64 of delinquent billings is recommended for placement on the 2008 tax roll. We expect a further reduction in delinquent billings up to the 2008 post date of the tax statements, projected for June 6, 2008. This is in keeping with past practice.  A listing of the delinquent accounts is available for inspection in the Clerk's office, and the Customer Service Center, 220 E Huron St, Suite 100.

Whereas, on April 7, 2008 the City Administrator reported to this Council that there were $157,773.05 of unpaid charges for water, sanitary sewer and stormwater services furnished to certain premises in the City which on March 31, 2008 had remained unpaid for a period of six months or more;

 

Whereas, in accordance with Michigan Public Act 94 of the Public Acts of 1933 and Ann Arbor City Ordinance Code; Chapter 13, Section 2:92; Chapter 29, Section 2:72 and Chapter 33, Section 2:206; collection notices have been sent by first class mail to the owners of such premises giving notice of the total amount due for such services and that such amounts would be assessed with a 10% penalty by this Council on May 8, 2008, unless sooner paid, as a tax against said premises;

 

Whereas, On April 8, 2008 such notices were sent by first class mail to the owners of the premises so served notifying them of the said Council meeting and of the assessment with the 10% penalty to be then placed against such property if the amount due is not paid by May 8, 2008; and

 

Whereas, payments and reductions of delinquent utility charges have been processed, and as of May 8th delinquent utility charges of $104,402.64 remain, which may further be reduced by additional amounts received prior to placement on the tax roll.

 

RESOLVED, That such outstanding (over 6 months) delinquent utilities charges be levied against such owners and premises and that the City Assessor shall place the same with a 10% penalty on 2008 summer tax statements and that the said charges so assessed shall be collected in the same manner as general City taxes.
