Attached for your review and approval is a resolution to approve a Professional Services Agreement with Testing Engineers & Consultants, Inc. for Construction Materials Testing Services for the Courts/Police Building in the amount of $98,962.00  
 
Work on the addition must be tested in accordance with the 2006 Michigan Building Code.  In general this includes shop and field inspections of the work, field and laboratory testing of construction materials, and engineering services to support, control, and document the results.  Specific examples of items tested are concrete strength, density and compaction testing of backfill, placement of reinforcing steel, masonry strength, structural steel (welding, bolting, and fabrication), roofing, and fireproofing.  
 
In response to our RFP No. 728, nine proposals were received.  Staff from Public Services, as well as Clark Construction and Quinn Evans, evaluated the proposals and selected Testing Engineers and Consultants for their work plan, qualifications, past involvement with similar projects, and competitive fee schedule.   
 
Testing Engineers & Consultants, Inc. received Human Rights and Living Wage approval on March 4, 2009.  Sufficient funds for these services are available in the City Hall Expansion project budget in the Civic Center Fund, 0008.

Whereas, It is necessary to retain a qualified testing firm to perform essential testing for the Courts/Police Bldg. project;
 
Whereas, Proposals for the testing services were received and evaluated by the Public Services Administration Unit;
 
Whereas, Testing Engineers & Consultants, Inc. submitted the best proposal, demonstrating the required qualifications, experience, and competitive fee schedule;
 
Whereas, Testing Engineers & Consultants, Inc. received Human Rights and Living Wage approval on March 4, 2009; and
 
Whereas, Sufficient funds for these services are available in the existing project budget.
 
RESOLVED, That a Professional Services Agreement with Testing Engineers & Consultants, Inc. in the amount of $98,962.00 ($93,962.00 plus $5,000.00 contingency) be approved for testing services for the Court/Police Bldg. project;
 
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to form by the City Attorney and approval as to substance by the City Administrator;
 
RESOLVED, That the City make the following declaration for the purpose of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds from Bonds; and
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
