Resolution of Intent to Vacate Boulevard Heights Alley, Located Between South Maple Road, Collingwood Drive, Abbott Avenue and Jackson Avenue (8 Votes Required)
Memorandum
Council passed a resolution of intent to vacate the Boulevard Heights Alley on January 22, 2008, with a notice of the public hearing to be published in The Ann Arbor News at least four weeks prior to the public hearing, which was to be scheduled for February 19, 2008. It has been determined that in addition to the public hearing notice, the resolution itself must be published in The Ann Arbor News. Because the February 19, 2008 date in the original resolution did not provide adequate time to place the resolution and public hearing notice in the newspaper, a revised resolution of intent is before Council for approval.
Approval of this revised resolution announces the City's intent to vacate Boulevard Heights Alley and serves as notification that City Council will hold a public hearing on this alley vacation on April 7, 2008. A resolution to approve the alley vacation also will be scheduled and placed on the April 7, 2008 Council agenda. A map indicating the area proposed for vacation is attached.

Whereas, There has been presented to the Council of the City of Ann Arbor a written request seeking the vacation of the entire portion of Boulevard Heights Alley, which is located between South Maple Road, Collingwood Drive, Abbott Avenue and Jackson Avenue;
Whereas, The Ann Arbor Planning Commission, at its meeting of December 18, 2007, reviewed the proposed vacation of Boulevard Heights Alley, contingent upon easements being maintained for public utilities; and
Whereas, If the Council deems it advisable and intends to vacate the alley above described, the City may reserve all easements and rights-of-way within the portions to be vacated for maintenance of public utilities;
RESOLVED, That the Council hereby appoints April 7, 2008 at 7:00 p.m. in the Council Chamber, City Hall, Ann Arbor, Michigan, as the time and place when and where the said Council will meet to hear objections, if any, to the vacation of the alley above described;
RESOLVED, That notice of such meeting, including a copy of this resolution, shall be published not less than four weeks before the time appointed for such meeting in The Ann Arbor News; and
RESOLVED, That objections to such proposed action of the Council may be filed with the City Clerk in writing and that all persons for or against such proposed action will be heard by the Council at the time and place of the public hearing herein before provided.
