Memorandum
Attached for your review and approval is a resolution to authorize a Professional Services Agreement with CTI & Associates, Inc. for construction materials testing services in the amount of $39,680.00 for the Huron Parkway-Nixon Road Improvement Project.  
 
With the City Council's approval the City of Ann Arbor will enter into an agreement with the Michigan Department of Transportation (MDOT) for the construction of Nixon Road-Huron Parkway Improvement Project in 2009. The construction phase of the project will require construction materials testing by a certified consulting firm.
 
In preparations for the project's construction phase, we received proposals from six firms for the required construction materials testing services.  Project Management staff evaluated the proposals and selected CTI & Associates, Inc. based on the proposal, staff qualifications, past involvement with similar projects, and cost.  CTI & Associates, Inc. received Human Rights and Living Wage approval on March 10, 2008.  
 
Services to be performed include all the required testing for soils, aggregate, asphalt, and concrete.  Funds for the requested services are available in the approved project budget for the Nixon Road - Huron Parkway Improvement Project.

Whereas, The Huron Parkway-Nixon Road Improvement Project includes reconstruction of Nixon Road and partial reconstruction of Huron Parkway north of Plymouth Road;
 
Whereas, The Nixon Road - Huron Parkway Improvement project is included in the approved 2008-2013 City of Ann Arbor Capital Improvements Plan;
 
Whereas, The Federal Highway Administration has allocated funds for the City of Ann Arbor Nixon Road- Huron Parkway Improvement project;
 
Whereas, The Michigan Department of Transportation has received bids for the construction of Nixon Road and Huron Parkway Improvement project; and
 
Whereas, It is necessary to retain a qualified testing firm to perform testing services for the Nixon Road-Huron Parkway-Improvement Project;
 
Whereas, Proposals were received by Procurement office and evaluated by Project Management staff on the basis of staff qualifications, past involvement with similar projects, proposed work plan, and cost;
 
Whereas, CTI & Associates, Inc. of Brighton, Michigan has submitted to the City a proposal for the necessary services, setting forth the services to be performed by said firm and the payments to be made by the City therefore, all of which are agreeable to the City;
 
Whereas, CTI & Associates, Inc. received Human Rights and Living Wage approval on March 10, 2008; and
 
Whereas, The required funds for the construction materials testing services are available in the project budget for the Nixon Road-Huron Parkway Improvement Project;
 
RESOLVED, That a Professional Services Agreement with CTI & Associates, Inc. in the amount of $39,680.00 be approved for construction materials testing services for the Nixon Road- Huron Parkway Improvement Project;
      
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said agreement after approval as to form by the City Attorney and approval as to substance by the City Administrator;
 
RESOLVED, That a contingency amount of $10,000.00 be established within the project budget and that the City Administrator is authorized to approve additional change orders to the construction contract with the CTI & Associates, Inc., not to exceed $10,000.00 in order to satisfactorily complete the project; and
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
