Attached for your review and approval please find a resolution to award a construction contract to Bailey Excavation, Inc. in the amount of $483,497.95 for the Maxwell, Wakefield & Lutz Water Main Replacement Project.
Budget/Fiscal Impact
The current Capital Improvements Plan (CIP) includes a project for the Maxwell, Wakefield & Lutz Water Main Replacement Project (UT-WS-18-03). Funding for the project is included in the approved capital budgets of the Water Supply System and the Street, Bridge and Sidewalk Millage Funds.
Project Description
The existing water mains within Maxwell Avenue, Wakefield Avenue, and Lutz Avenue that will be replaced are in poor condition and do not provide adequate water flow to support the necessary fire protection. This project consists of the installation of approximately 980 feet of new ductile iron pipe within these three dead end streets. In addition, the project will replace some storm sewer structures. After the utility work is completed, the streets will be resurfaced, including the replacement of some curb and gutter. This work is expected to begin in June of 2017 following the end of the school year for Ann Arbor Public Schools, and is scheduled to be completed by the end of August.
Plans and specifications were advertised through BidNet. Five bids were received and opened on April 11, 2017. The lowest responsible bid from Bailey Excavating, Inc., in the amount of $483,497.95 was $26,777.05 below the engineer's estimate. Attached is a summary of the bids received for the project.
Bailey Excavation, Inc. complies with the requirements of the City’s non-discrimination and living wage ordinances.

Whereas, The existing water mains within Maxwell Avenue, Wakefield Avenue and Lutz Avenue are in poor condition and undersized, and are in need of replacement;
Whereas, The Capital Improvements Plan (CIP) includes the Maxwell, Wakefield & Lutz Water Main Replacement Project (UT-WS-18-03);
Whereas, Funding for this project is included in the Water Supply System and the Street, Bridge and Sidewalk Millage Funds approved capital budgets;
Whereas, Competitive bids were received by the Office of Procurement on April 11, 2017 for the Maxwell, Wakefield & Lutz Water Main Replacement Project (ITB-4472) and Bailey Excavation, Inc. was the lowest responsible bidder with a submitted bid of $483,497.95;
Whereas, The contractual proposal sets forth the services to be performed by said company, and the payments to be made by the City therefore, all of which are agreeable to the City;
Whereas, It is now necessary to enter into a Contract with said company for this construction project; and
Whereas, Bailey Excavation, Inc. complies with the requirements of the City’s Non-Discrimination and Living Wage Ordinances;
RESOLVED, That a contract in the amount of $483,497.95 be awarded Bailey Excavation, Inc. for the construction of the Maxwell, Wakefield & Lutz Water Main Replacement Project;
RESOLVED, That a contract contingency amount of $48,350.00 be established within the project budget and that the City Administrator be authorized to approve additional change orders to the construction contract with Bailey Excavation, Inc. not to exceed $48,350.00 in order to satisfactorily complete this project;
RESOLVED, That the City makes the following declaration for the purpose of complying with the reimbursement rules of Treasury Regulations 1.150-2 pursuant to the Internal Revenue Code of 1986, as amended, that the City reasonably expects to reimburse itself for expenditures for the costs of the Project with proceeds of Bonds; and
RESOLVED, That the Mayor and City Clerk be authorized and directed to execute said contract after approval as to form by the City Attorney, and approval as to substance by the City Administrator; and
RESOLVED, That the City Administrator be authorized to take necessary administrative actions to implement this resolution, including issuing temporary and permanent Traffic Control Orders and night work authorizations as required for the construction of the project.
