Resolution to Approve an Amendment to the Services Agreement with Haengel & Associates Engineering, Inc. ($29,171.00) for Material Testing Services for the Recycle Rule Compliance Project
Memorandum
This memorandum and resolution requests approval to amend the Services Agreement for material testing with Haengel & Associates Engineering, Inc. by $5,000.00 increasing the value of their contract to $29,171.00.  The original agreement for $24,171.00 was established on October 11, 2006 to provide material testing services for the Recycle Rule Compliance Project.  Several unforeseen conditions during construction have required the need for additional testing services.  These conditions included re-testing of some concrete that appeared not to meet the project specifications.  This work was paid for by the City, but reimbursed by the General Contractor.  In addition, because of the complexity of the project and how the earthwork and concrete work were staged, approximately 20 additional days of testing were required over and above that included in the original scope of work.
 
Since Haengel & Associates has performed all of the testing services on this project, it is proposed that they complete the balance of the work to be performed.  The unit prices for testing provided as part of their original proposal remain valid for the remainder of the work.
 
An increase of $5,000.00, for a total services agreement amount of $29,171.00 is requested for Haengel & Associates Engineering, Inc. to complete the balance of the materials testing for the Recycle Rule Compliance Project.
 
Haengel & Associates Engineering, Inc. has received Human Rights approval on November 1, 2007, and complies with the living wage ordinance.
 
Sufficient funds for this Amendment ($5,000.00) plus the original contract ($24,171.00) for a total of $29,171.00 are available in the Council-approved project budget for the Recycle Rule Compliance Project.

Whereas, It is necessary to adequately test materials placed as part of the Recycle Rule Compliance Project to  ensure compliance with the project specifications;
 
Whereas, Haengel & Associates Engineering, Inc., as the testing agent for this project to date, is uniquely qualified to complete the expanded scope of work because of their intimate knowledge of this project;
 
Whereas, Sufficient funds for this amendment are included in the Council-approved project budget for the Recycle Rule Compliance Project; and
 
Whereas, Haengel & Associates Engineering, Inc. has received Human Rights approval on November 1, 2007, and complies with the living wage ordinance;
 
RESOLVED, That Council approves an amendment to the services agreement for $5,000.00 with Haengel & Associates Engineering, Inc., increasing the value of their service agreement to $29,171.00, to complete the balance of the material testing for the Recycle Rule Compliance Project;
      
RESOLVED, That the Mayor and City Clerk are authorized and directed to execute the agreement for services after approval as to substance by the City Administrator and approval as to form by the City Attorney; and
 
RESOLVED, That the City Administrator be authorized to take the necessary administrative actions to implement this resolution.
