Attached for your review and approval is Change Order No. 1 to the construction contract with Anglin Civil, LLC for the Wheeler Facility Pond Dredging Project (ITB #4665).
This dredging project was approved by City Council at the very beginning of 2022. However, the project did not start due to permitting issues and delays with the Michigan Department of Environment, Great Lakes and Energy (EGLE). A permit was eventually issued in late 2022, however construction scheduling with compost facility operations did not allow the project to be completed until this upcoming winter.
Since the time of the original bid, construction costs and staff rates have increased. The total cost for the increase is $303,473.88, for a total contract amount of $1,262,267.87.
The work included in Change Order No. 1 consists of price modifications to the original construction estimate.
The contingency in the original contract was $95,879.39, which is insufficient to address the cost increase. City staff is recommending re-establishing a contingency of $126,500.00 for potential future change orders.
Budget/Fiscal Impact: The total cost estimate for the project is $1,500,000.00 with funds split between the Solid Waste and Stormwater Funds based on the ponds function.

Whereas, The Wheeler Facility Pond Dredging Project (ITB #4665) was bid, and City Council approved a contract with Anglin Civil, LLC in February 2022 for the project;
Whereas, There were permitting issues and delays that significantly held up the start of construction;
Whereas, Compost facility operations at the Wheeler Service Center limit the construction schedule, so as not to interfere with operations;
Whereas, There is Funding is available in the approved Stormwater Fund and the Solid Waste Fund Capital Budgets to cover this change order;
RESOLVED, That City Council approve Change Order No. 1 to the Construction Contract with Anglin Civil, LLC in the amount of $303,473.88 for a total contract amount of $1,262,267.87 for the Wheeler Facility Pond Dredging Project (ITB #4665);
RESOLVED, That a contingency is re-established in the amount of $126,500.00 to finance change orders to the contract to be approved by the City Administrator;
RESOLVED, That all amounts authorized herein are without regard to fiscal year; and
RESOLVED, That the City Administrator be authorized to take all necessary actions to implement this resolution including any changes or amendments that do not exceed the contingency amount.
