How Established: Section 1:197, Chapter 8, Title I of the Ann Arbor City Code. This Board was created in accordance with Act 207, Public Acts of Michigan, 1921 as amended. Purpose: To hear and decide appeals and to authorize variances from the strict application of the Code on the finding of practical difficulty or undue hardship with supporting affirmative findings; Administrative Review to hear and decide appeals where alleged that there is error in any order, requirement, permit, decision, or refusal made by the Building Official or any other administrative official in enforcing any provision of Chapter 55; Power to approve substitution of one non-conforming use for another (5:86); Power to approve continuation or replacement of nonconforming structure (5:87); Board to hear matters to be appealed from Zoning Chapter; Landscape Ordinance; Off-Street Parking Ordinance; Fence Ordinance; Streets Ordinance; Historic District Ordinance. Special Qualifications for Appointment: None. However, a mixture of professionals is recommended, such as lawyers, architects, landscape architects, real estate, business and lay persons. Length of Terms: 3 Years. Meeting Times and Frequency: 4th Wednesday of each month at 6 p.m. at 301 E. Huron St., 2nd Floor, Council Chamber Membership / Committee Composition: 9 members including 1, but not more than 2 Councilmembers. The Chairperson's of the Board shall be designated by the Council.
