How Established: This board expired on June 30, 2015 by way of R-509-12-04. By Resolution No. R-509-12-04 approved on December 6, 2004, governed by the Charter for the City of Ann Arbor, and authorized by Section 5:17 of the Charter. This Board will expire on June 30, 2015. Purpose: To provide advice to City Council, the City Administrator, the Community Services Area Administrator and the Building Official relative to the City’s Construction Code related activities. Although the advice, input and recommendations provided by the Board are advisory in nature only, and although any input, advice or recommendations made by the Board may be accepted or rejected, in whole or in part, at the sole discretion of the City (including, but not limited to the City Council, City Administrator, Community Services Area Administrator, and the Building Official), the City Council, City Administrator, Community Services Area Administrator, and Building Official will review the comments, advice, input and recommendations of the Board as they are received. (There is nothing in the creation of this Board that alters the existing relationships between the City Council, the City Administrator, the Community Services Area Administrator, and other City entities or persons. Special Qualifications for Appointment: A. Members of the builders and contractors industries. B. Design professional with relevant experience or other professional with relevant experience. C. City employees or contract employees managerial positions in the City’s Community Services Service Area. Length of Terms: 2 City employees or contract employees (shall serve until their employment with the city is terminated.). The initial term for one of the two members described in A, for one of the two members described in B, and for the single member described in C above will be two years. The initial term for one member in A and B above will be three years. Subsequent terms for all five members of the Board will be three years. Except for the members who are appointed by virtue of their positions with the City, no member serving continuously for six (6) years shall be eligible for reappointment until a lapse of three years. For the members appointed initially to a two-year term, the six years shall not start to accrue until the beginning of their appointment to a full three-year term. Meeting Times and Frequency: The Board shall, at a minimum, hold meetings on a quarterly basis, but shall have authority to meet as frequently as the Board deems appropriate. The Board shall operate with a quorum of at least four members. Any action taken or recommended by the Board must be approved by the vote of at least three Board members. Membership/Committee Composition: The Construction Code Unit Advisory Board membership shall be composed of five (5) voting members nominated by the Mayor and appointed by the City Council as follows: A. Two (2) members shall be City employees or contract employees managerial positions in the City’s Community Services Service Area who shall serve by virtue of their positions with the City and be approved by the Community Services Area Administrator, and who will be replaced when if their employment with the City terminates. B. Two (2) members shall be members of the builders and contractors industries. C. One (1) member shall be a person nominated by the other four members, preferably a design professional with relevant experience or other professional with relevant experience; this nominee shall be forwarded to the Mayor. If the four members cannot reach consensus on a nominee, then the Board shall nominate and forward to the Mayor, one or more persons who have been approved by at least three Board members. Under either scenario, the Mayor shall not unreasonably withhold this nomination from the City Council and the Council shall not unreasonably withhold its approval of the appointment. D. The initial term for one of the two members described in A, for one of the two members described in B, and for the single member described in C above will be two years. The initial term for one member in A and B above will be three years. Subsequent terms for all five members of the Board will be three years. E. The builder and contractor industry members of the Construction Code Activities Advisory Board shall be nominated by the Mayor from nominations submitted by the Home Builders Association of Washtenaw County ("HBA") and the Washtenaw Contractors Association, Inc. ("Contractors"). HBA will nominate one or more candidates for one of the two Board seats described in B, above, and the Contractors will nominate one or more candidates for the other seat described in B. Each organization shall make nominations for both the initial appointee to the seat, and any succeeding appointees who are asked to serve by virtue of the resignation, death or disability of a prior appointee, or the decision of a prior appointee not to seek an additional term. The Mayor shall not unreasonably withhold this nomination from the Council and the Council shall not unreasonably withhold its approval of the appointment of any nominee submitted by HBA or the Contractors. F. Except for the members who are appointed by virtue of their positions with the City, no member serving continuously for six (6) years shall be eligible for reappointment until a lapse of three years. For the members appointed initially to a two-year term, the six years shall not start to accrue until the beginning of their appointment to a full three-year term.
